Amicus curiae before the African Commission on Human and Peoples’ Rights in housing rights case the Democratic Republic of Congo

The ESCR-Net, of which DPLF is a member, has intervened as amicus in the Thubakgale case before the High Court in South Africa, a decades-long case litigated by the Socio-Economic Rights Initiative in South Africa on behalf of 133 families seeking to vindicate their right to adequate housing in terms of both domestic and international law.

Implementation Free, Prior, and Informed Consent and Consultation: Comparative Experiences in Latin America and Discussions on a Consultation Law in Mexico

In Mexico and in other countries in the region, the adoption of norms of general application has been discussed as an alternative to the implementation of the right to free, prior, and informed consent and consultation (FPIC) of indigenous peoples. With this publication, DPLF and Oxfam-Mexico seek to contribute to this discussion, based on the analysis of international standards, comparative law, and the challenges faced by other countries in the region.

This report analyzes the 2016 advisory opinion that Colombia requested from the Inter-American Court of Human Rights in 2016, regarding the following issues:

  • What is the scope of application of the state obligations related to environmental protection that arise from the American Convention on Human Rights (ACHR)?
  • What are the environmental obligations of states that arise from the obligations to protect and guarantee the rights to life and personal integrity enshrined in the ACHR?

This report, titled Indigenous Peoples, Afro-Descent Communities, and Natural Resources, summarizes a report by the Inter-American Commission on Human Rights (IACHR) on human rights protections in the context of extraction, exploitation, and development activities.

The nature of the rights at stake and the severity of the eects reported make the impact of these extractive activities a “priority issue in the region” and gave rise to the IACHR report.
