{"id":21518,"date":"2013-11-04T11:41:50","date_gmt":"2013-11-04T16:41:50","guid":{"rendered":"https:\/\/dplf.org\/en\/?p=21518"},"modified":"2024-09-12T11:44:02","modified_gmt":"2024-09-12T15:44:02","slug":"dplf-and-partner-organizations-participated-in-a-hearing-before-the-iachr-on-the-role-of-latin-american-courts-in-the-investigation-and-punishment-of-grave-human-rights-violations","status":"publish","type":"post","link":"https:\/\/dplf.org\/en\/2013\/11\/04\/dplf-and-partner-organizations-participated-in-a-hearing-before-the-iachr-on-the-role-of-latin-american-courts-in-the-investigation-and-punishment-of-grave-human-rights-violations\/","title":{"rendered":"DPLF and partner organizations participated in a hearing before the IACHR on the role of Latin American courts in the investigation and punishment of grave human rights violations"},"content":{"rendered":"<p class=\"rtejustify\"><strong>The organizations denounced the persisting weaknesses of criminal systems, which undermine the duty of States to prosecute these crimes and combat impunity, even when most of the region has made progress in defeating amnesty laws.<\/strong><\/p>\n<p class=\"rtejustify\">On November 1st, Due Process of Law Foundation (DPLF) along with Fundacion de Estudios para la Aplicacion del Derecho ( FESPAD ) from El Salvador, Instituto de Defensa Legal (IDL) from\u00a0 Peru, Centro de Investigaci\u00f3n y Docencia Econ\u00f3micas from Mexico, Myrna Mack Foundation from Guatemala and Centro de Derechos Humanos de la Facultad de Derecho de la Universidad Diego Portales from Chile, participated in a hearing convened by the Inter-American Commission on Human Rights (IACHR) during the 149\u00ba\u00a0 period of sessions.<\/p>\n<p class=\"rtejustify\">At this hearing, the organizations presented a report documenting progress,\u00a0<strong>obstacles and challenges remaining in the prosecution of grave human rights violations by domestic judicial systems in Guatemala, El Salvador, Argentina, Peru and Chile<\/strong>, and requested that the Commission strengthen its\u00a0<strong>dialogue with the States<\/strong>,\u00a0<strong>in particular with the Judiciary<\/strong>, so that\u00a0<strong>the pending cases are effectively investigated and prosecuted<\/strong>, and to consider preparing a<strong>\u00a0thematic report to systematize the jurisprudence of Inter-American system of human rights on due diligence<\/strong>\u00a0in investigating these crimes and best practices developed by national justice systems on this matter.<\/p>\n<p class=\"rtejustify\">The information provided was based on a recent DPLF publication titled\u00a0<strong><em>Digest of Latin American jurisprudence on international crimes, Volumes I and II<\/em>\u00a0<\/strong>, authored by Ximena Medell\u00edn, which compiles and analyzes the most important judicial decisions concerning the prosecution of international crimes of the continent, as well as other publications and litigation experiences of the other organizations.<\/p>\n<p class=\"rtejustify\">During the hearing, the organizations informed the Commission that in the last decade in Latin America there has been remarkable progress in breaking down the legal obstacles, such as amnesties, for the prosecution of those responsible for crimes committed in armed conflict or military dictatorships, through judicial decisions of constitutional courts that led to the judgments of criminal courts.
