{"id":22152,"date":"2015-03-20T07:38:46","date_gmt":"2015-03-20T11:38:46","guid":{"rendered":"https:\/\/dplf.org\/en\/?p=22152"},"modified":"2024-09-17T07:40:00","modified_gmt":"2024-09-17T11:40:00","slug":"press-release-human-rights-organizations-issue-a-statement-on-the-implementation-of-the-right-to-prior-free-and-informed-consultation-consent-in-latin-america","status":"publish","type":"post","link":"https:\/\/dplf.org\/en\/2015\/03\/20\/press-release-human-rights-organizations-issue-a-statement-on-the-implementation-of-the-right-to-prior-free-and-informed-consultation-consent-in-latin-america\/","title":{"rendered":"PRESS RELEASE: Human rights organizations issue a statement on the implementation of the right to prior, free and informed consultation &#038; consent in Latin America"},"content":{"rendered":"<p class=\"rtejustify\"><strong>Washington, D.C., March 20, 2015.\u00a0<\/strong>The below signed organizations recognize that in spite of advances in the implementation of the Right to Prior, Fee and Informed Consultation and Consent (PFICC) in Latin America, a series of barriers persist and hinder the implementation of this guarantee, which put at risk indigenous peoples, tribes or similar communities (peoples from here on).<\/p>\n<p class=\"rtejustify\">Among the main obstacles, we wish to highlight the following:<\/p>\n<p class=\"rtejustify\"><strong>1.\u00a0<\/strong><strong>States have not brought their legislation into compliance with international standards on the right to\u00a0<\/strong><strong>PFICC<\/strong>. In those countries where regulations have been issued, they share one characteristic: they reduce the protection of the peoples\u2019 right to PFICC.<\/p>\n<p class=\"rtejustify\"><strong>2.\u00a0<\/strong><strong>States must change their institutions in order to carry out appropriate\u00a0<\/strong><strong>PFICC<\/strong><strong>\u00a0processes.<\/strong>\u00a0Keeping in mind the violation of the right to PFICC and the increase in socio-environmental conflicts, the States should guarantee at the minimum:<\/p>\n<p class=\"rtejustify rteindent1\">(i) Autonomous and effective institutions, equipped with sufficient resources to carry out these processes;<\/p>\n<p class=\"rtejustify rteindent1\">(ii) Information and communication mechanisms for these processes;<\/p>\n<p class=\"rtejustify rteindent1\">(iii) Independent and transparent mechanisms to follow-up on compliance with the agreements reached between the peoples and the State;<\/p>\n<p class=\"rtejustify rteindent1\">(iv) Benefits for the peoples free of any coercion or conditions;<\/p>\n<p class=\"rtejustify rteindent1\">(v) Reparations for the peoples in cases where damages have been suffered.<\/p>\n<p class=\"rtejustify\"><strong>3.\u00a0<\/strong><strong>Deficiencies in the judicial protection of the right to\u00a0<\/strong><strong>PFICC<\/strong>: In spite of advances derived from judicial decisions that comply with international standards for the right of PFICC, a series of geographic, economic and cultural barriers persist to full access to justice or compliance with the decision.<\/p>\n<p class=\"rtejustify\"><strong>4.\u00a0<\/strong><strong>Deficiencies in the legal interpretation of the right to\u00a0<\/strong><strong>PFICC<\/strong><strong>:<\/strong>\u00a0States have misinterpreted the right to PFICC in defining the moment to hold a process, identifying the subjects of the right, the stages of the process and the allowed time to develop the process.<\/p>\n<p class=\"rtejustify\">In view of this situation, we remind the States that the PFICC is a recognized international human right of the peoples. For this reason, we urge the States of our region to modify the norms and administrative measures that impede the exercise of this right.<\/p>\n<p class=\"rtejustify\">\n<p class=\"rtejustify\"><strong>Signing organizations:<\/strong><\/p>\n<p class=\"rtejustify\">Asociaci\u00f3n Inter\u00e9tnica de Desarrollo de la Selva Peruana \u2013\u00a0<a href=\"http:\/\/www.aidesep.org.pe\/\" target=\"_blank\" rel=\"noopener\">Aidesep<\/a>;
